Terms of Service

1. Acceptance of terms

By accessing or using FableFactory (“the Service”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Service. You must be at least 13 years old (16 in the EEA/UK) to use the Service.

2. Description of service

FableFactory is a browser-based creative platform that lets you generate images with AI, animate them into video, and edit content on a multi-track timeline, individually or with collaborators. The Service is provided on an “as is” and “as available” basis.

3. Accounts and security

You may sign in with email and password, a one-time email code, or a Google account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly at support@fablefactory.io if you suspect unauthorized access. When you change your account email, confirmation may be required from both your current and new addresses.

4. Subscriptions, tokens, and billing

• Plans: Paid subscriptions renew monthly at the price shown at checkout until canceled. You may upgrade, downgrade, or cancel in Account Settings; changes take effect as shown at the time of the change.
• Tokens: AI generation consumes tokens. Subscribing to a paid plan grants a monthly token allotment, and additional token packs may be purchased separately. Tokens have no cash value, are non-transferable, and cannot be redeemed for money.
• Failed generations: Tokens are held when a generation starts and refunded in full to your balance if the generation fails on our side. Tokens for completed generations are consumed regardless of whether you like the result.
• Refunds: All payments are final except where required by law. Canceling your subscription or deleting your account does not entitle you to a refund of fees already charged, and any unused tokens are forfeited on account deletion. If you believe you were charged in error, contact us at support@fablefactory.io within 14 days of the charge.
• Payment failures: If a subscription payment fails, we may retry the charge and/or suspend paid features until payment succeeds.
• Payments are processed by Stripe; you also agree to Stripe's applicable terms when providing payment details.

5. Your content and ownership

You retain ownership of the content you upload and, to the extent permitted by applicable law and the terms of the underlying AI model providers, of the content generated from your prompts. By using the Service, you grant us a limited, worldwide, non-exclusive license to store, process, transmit, and display your content solely as needed to operate and improve the Service (for example, to render your storyboards, serve media to you and your collaborators, and transmit prompts to AI providers).

We do not use your content to train AI models. Note that the copyright status of AI-generated material varies by jurisdiction, and we make no guarantee that generated output will be eligible for copyright protection in your jurisdiction.

6. Acceptable use

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Create, upload, or share content that is illegal, sexually explicit involving minors, non-consensual intimate imagery, hateful, harassing, defamatory, or that promotes violence or self-harm.
• Create misleading deepfakes or impersonations of real people without their consent, or content intended to deceive, defraud, or manipulate.
• Infringe intellectual property, publicity, or privacy rights of others, including uploading media you do not have rights to use.
• Attempt to interfere with, probe, or disrupt the Service or its infrastructure, or use automated scripts or bots without permission.
• Circumvent token metering, generation limits, or other usage controls.

We and our AI providers may use automated and human moderation. Content that violates these rules may be removed, and accounts may be suspended or terminated.

7. AI-generated content

Outputs produced by AI models are probabilistic and may not match your prompt, may contain errors, and may be similar to outputs generated for other users. We do not guarantee the quality, accuracy, or suitability of generated content for any purpose. You are responsible for reviewing generated content before publishing it and for complying with the terms of any third-party AI provider whose models are used through the Service.

8. Collaboration

Project owners may invite collaborators with roles (such as Editor or Viewer). Owners are responsible for the people they invite. Collaborators' generations may consume the owner's tokens, and owners can remove collaborators at any time. Do not invite people you do not trust with the project's content.

9. Media retention

Media not referenced by any storyboard or timeline may be automatically deleted after 60 days, and media you delete is held in a recoverable state for approximately 30 days before permanent deletion, as described in our Privacy Policy. We are not a backup service — you are responsible for exporting and keeping copies of any content you cannot afford to lose.

10. Termination

You may stop using the Service and delete your account at any time in Account Settings. We may suspend or terminate your access at any time, with or without notice, for conduct that we reasonably believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ends immediately and unused tokens are forfeited.

11. Disclaimers

The Service is provided without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that generations will succeed or meet your expectations.

12. Limitation of liability

To the fullest extent permitted by law, FableFactory and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including lost profits, lost data, or lost content) arising out of or related to your use of the Service. Our aggregate liability for any claim relating to the Service shall not exceed the greater of the amounts you paid us in the twelve months preceding the claim or one hundred U.S. dollars ($100).

13. Indemnification

You agree to indemnify and hold harmless FableFactory from claims, damages, and expenses arising out of your content, your use of the Service, or your violation of these Terms.

14. Changes to terms

We may modify these Terms at any time. We will post the updated version on this page with a revised “Last updated” date, and provide additional notice of material changes where required. Continued use of the Service after changes constitutes acceptance of the revised Terms.

15. Governing law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any dispute shall be resolved in the state or federal courts located in California, except where applicable consumer law gives you the right to bring claims elsewhere.
